Indefinite Leave to Remain (Settlement) – Permanent UK Residency
Indefinite Leave to Remain (ILR), or Settlement, is the status that allows you to live, work, and study in the UK without any time limits. Achieving ILR is a key milestone on the path to long-term settlement or British citizenship. Based on your Immigration history, you may be eligible to apply. Our immigration experts guide applicants through each stage – from confirming eligibility to submitting the application and beyond.

Key Eligibility Criteria
Qualifying Residence:
In most cases, you need 5 years of continuous lawful stay under the Immigration Rules (such as a Skilled Worker, Spouse, or Dependent visa etc). Some routes include 10-year long residence. Some routes do allow to obtain ILR after 3 years such as Innovator Founder Visa or Global Talent Visa Route.
Continuous Residence & Absences:
You must not have breached immigration rules during the qualifying period. Generally, you cannot exceed 180 days abroad in any 12-month period. Even short trips beyond the limit can reset eligibility. Our dedicated team carefully review your travel history and advise you according to the rules.
English & Life in the UK:
Pass the Life in the UK Test and meet English language requirements (typically CEFR level B1/B2, unless exempt). We help you prepare for and schedule these requirements.
Good Character:
Demonstrate good character throughout your qualifying period. This means no serious criminal convictions, no dishonesty to the Home Office, and no significant debts to public body. We review any potential issues (such as past convictions or debt issues) and advise on the best possible outcome tailored to your needs.
Lawful Status Throughout:
You must have valid leave for the entire qualifying period. Time spent illegally (after a visa expiry without extension) generally does not count. We advise whether any gaps may affect your eligibility.
Application Process
Eligibility Review:
We thoroughly examine your visa history, absences, and other factors (e.g. criminal record) to confirm ILR eligibility under the correct route.
Collect Documents:
Gather and organize required documents: current passport, proof of residence covering the qualifying period, employment or family documents, Life in the UK certificate, English test certificate, etc. Our checklist makes sure all necessary paperwork is prepared.
Submit and Pay:
Submit the application online and pay the fee (currently about £3,029 per person, plus optional priority fees). We recommend priority service (5-day decision or 2-day super priority) if quick resolution is needed.
Biometrics Appointment:
Book and attend a UKVCAS appointment to give fingerprints and photos. We ensure you’re ready for this step and know what to bring.
Await Decision:
Standard decisions take up to 6 months, though priority applications are faster. We track your case and communicate with UKVI if there are delays. Once approved, you will receive your ILR status via official communication channels used by UKVI.
Common Challenges
Complex Requirements:
Different ILR routes have different rules. For example, the strict 180-day limit is calculated on a rolling basis. We interpret and apply the rules accurately so you avoid unexpected refusals.
Absence Tracking:
Keeping careful track of travel dates is critical. Even a single long absence can break your continuous residence. We assess your absences and advise whether to delay or proceed with the application.
Document Issues:
Missing or inconsistent evidence of residence is a common pitfall. Our team thoroughly checks your documents to ensure a complete record (for instance, matching address details across all bills and statements).
Changing Rules:
Home Office rules can change, such as the move to digital status or proposed “earned settlement” changes. We stay informed on policy updates to ensure your application aligns with current law.
Processing Times:
Applications for ILR often face long processing times due to high demand. We advise on premium processing options when needed and keep you updated on expected timelines.
Route Assessment:
Confirm whether you should apply under a 5-year, 10-year, or spouse route. If you’re close to a qualifying deadline, we advise on the optimal timing to apply.
Legal Representation
We assist you in presenting your case before Home Office and Judge with our legal representations based on your evidence
Form Accuracy:
Complete your ILR application with precision, matching information across forms and documents. This minimizes queries or errors from the Home Office.
Stress Reduction:
Explain every requirement in clear terms, so you know what to expect. We handle communication with UKVI/Home Office and Courts/Tribunals on your behalf, reducing your stress.
Issue Resolution:
If any issues arise, we advise how to address them proactively.
After-Submission Guidance:
We track the outcome of your application, assist in E-visa if needed, and explain any next steps such as application for Travel document, route specific requirements for ILR or British Citizenship

FAQ – Indefinite Leave to Remain (ILR)
Q: When exactly can I apply after 5 years?
The earliest you can apply is 28 days before you are due to complete qualifying period.
Q: Do different visas count together for ILR?
Yes. this is known as 10 years long residency route. You can apply for ILR if you have lived in the UK for 10 years lawfully on a combination of different visas (some visa categories are exempt from this route).
Q: I had a gap in my visa – does it matter?
Any period without lawful leave may interrupt continuous residence. If a gap was short, it might still be taken into consideration. We evaluate your exact situation and advise whether to apply or wait.
Q: Can I travel after I apply?
You should avoid travel immediately after applying, as your current visa is needed to re-enter until ILR is granted. Once ILR is approved (often via a digital share code if you applied in the UK), you can travel freely without needing to renew a visa.
