Naturalisation as a British Citizen

British citizenship is the final step for many lawful UK residents. Through naturalisation, eligible individuals become British citizens, gaining a UK passport and full civic rights. This route is available to those with settled status (usually ILR) who have lived in the UK for a qualifying period. Our immigration lawyer assist applicants through every stage of the citizenship process, ensuring your application is accurate and well-supported.

Key Eligibility Criteria

Settled Status (ILR):
You must usually have held Indefinite Leave to Remain or Settled status for at least 12 months before applying. If married to a British citizen or in a civil partnership with one, you can apply as soon as you obtain ILR.

Residence Period:
Typically, you must have lived in the UK for 5 years (3 years if married to a British citizen or civil partner). During this time, you should not have spent more than 450 days outside the UK in total (no more than 90 days in the last 12 months) unless an exception applies.

Life in the UK & English:
Pass the Life in the UK Test and meet English language requirements (usually CEFR level B1 or holding a degree taught in English), unless exempt due to medical reasons or if you are from one of the exempted countries.

Good Character:

Since February 2025 the Home Office is taking Good Character requirement very seriously in dealing with Citizenship applications. You should demonstrate good character (no serious criminal history, no immigration fraud, no unresolved debts). We review your record and advise you on any issues in your good character requirement to be satisfied. A slight overlook can cost you your British Citizenship

Application Process

Pre-application Review:
We check your immigration history, residence absences, and any other factors (like criminal record, good character requirement) to confirm all criteria are met.

Document Preparation:
Compile necessary documents: passports, Biometric Residence Permit (BRP), marriage/civil partnership certificate (if applicable), children’s birth certificates (if included), Life in the UK Test pass notification, English test certificate, and any relevant references. Our comprehensive checklist ensures a complete pack.

Complete Form AN:
Fill out the British citizenship application (Form AN for most, or Form M if applying as a spouse of a British citizen). We double-check every section for accuracy, as small mistakes can cause delays.

Submit and Pay:
Lodge the application online and pay the fee (currently about £1,735)

Biometrics
Attend a biometrics appointment and provide supporting documents

Decision & Ceremony:
Decisions often take 3–6 months, sometimes longer. Once approved, you will be invited to a citizenship ceremony to swore allegiance to the Crown. After the ceremony, you officially become a British citizen. We assist you on booking the ceremony and obtaining your first British passport.

Common Challenges

Strict Residency Rules:
Even a few extra days abroad can cause refusal. We carefully calculate your absences and advise if you should delay applying to meet the exact limits.

Language and Test:
Failing the Life in the UK Test or not meeting the English standard means refusal. We guide you in preparing for and passing these exams.

Good Character Checks:
Even minor past issues (like a driving conviction or unpaid fines) must be declared. We review your record and help you explain any issues in the application where possible.

Document Gaps:
Missing or incorrect paperwork is a common cause of delay or refusal. We ensure all required documents (for you and your family, if applicable) are included and properly translated if needed.

Processing Times:
Applications typically take up to 6 months.

Dual Nationality:
The UK allows dual citizenship, but you should check your other country of nationality laws. We explain any implications and advise accordingly.

Frequently Asked Questions (FAQ)

Q: Can I keep my original nationality?
Yes. The UK allows dual citizenship. You will not lose your original nationality by becoming British unless your home country requires renunciation. We can discuss any concerns related to your specific circumstances.

Q: How many days can I be absent from the UK?
Generally, absence period depends on your route to ILR. If you have spent excess time outside UK that can be disregarded, subject to certain conditions. We calculate your absences precisely to confirm eligibility.

Q: Can my children apply with me?
Children under 18 can be included if at least one parent is becoming a citizen or settled and has parental responsibility. Each child will still need their own application form, but supporting documents overlap. We help coordinate family applications.

Q: How long does it take to become a citizen?
Home Office decisions typically arrive in 3–6 months. After approval, you must attend a ceremony. We keep you informed of current processing times and help expedite where possible.
